The police are warning against property damage and disturbances of the peace during the upcoming Halloween celebrations. In this tradition, children and young people go from house to house on the evening of October 31 and give residents the choice between a nasty trick or a sweet treat with the words “trick or treat.”
Defacing or smearing houses or cars, damaging mailboxes, destroying garbage cans, but also threatening people or theft are criminal offenses that will be reported without exception. The police will also be stepping up patrols during this period and will intervene in the event of possible criminal offenses.
Even though children under the age of 14 cannot be prosecuted, victims can file civil claims and seek compensation for the damage caused, such as cleaning the facade of a house. In addition, a report will be made to the responsible youth welfare service.
The police are therefore asking all parents and guardians to have a clarifying discussion with their children and teenagers before Halloween: Make your children aware that often harmless “pranks” constitute criminal offenses.
“Explain to them the best way to go about their ‘Halloween tour.’ It makes sense to sit down with your children and decide when they are allowed to go out, with whom, until what time, and what is and isn’t allowed. The legal framework for this is provided by the Youth Protection Act,” according to the executive.
