Parking rule: one must ensure a minimum distance on the sidewalk

The new amendment to the Road Traffic Act has been in force since October 1. Drivers should now pay particular attention when parking.

Since October, road users must abide by new road rules. While cyclists are now allowed to turn right at traffic light-controlled intersections with appropriate signage even when the light is red, the rights of pedestrians have also been “strengthened.” For motorists, on the other hand, parking rules have been tightened considerably.

If you park your car now as a cross-parker, you must ensure a minimum distance on the sidewalk. Especially in big cities, it has been a known problem that larger SUVs and off-road vehicles protruded their bumpers onto the sidewalk.

ÖAMTC lawyer Nikolaus Authried explained: only compliance with the pavement markings was considered mandatory.

This will probably no longer be possible because the legal loophole was regulated with the 33rd StVO amendment. Car bumpers projecting into bicycle lanes and pedestrian surfaces has been forbidden since the new rule’s implementation.

However, vehicles are still allowed to protrude slightly into areas for pedestrian traffic, for example, with the side mirror or the bumper. However, at least 1.5 m must remain accessible for pedestrian traffic.
