Starting today: 3G rule in workplace will be implemented

From November 1, the 3G rule will apply in the workplace, which will then become a 2.5G rule from November 15. All those who cannot rule out physical contact with others at the workplace must carry proof of vaccination, recovery or testing. However, there is a 14-day transition period: up to and including November 14, all those who do not carry 3G proof with them at the workplace can instead wear an FFP2 mask at all times.

From November 15, however, the test certificate will be mandatory. And from that date, according to Health Minister Wolfgang Mückstein (Greens), an antigen test will no longer be sufficient; unvaccinated people will then have to carry a current negative PCR test (“2.5G”).

Employers only have to check compliance with the rule at the place of work on a random basis. Violations could result in penalties of up to 500 euros for employees and up to 3,600 euros for employers. In recent days, labor lawyers have criticized the unclear provisions, such as whether companies must keep records of their employees’ status – which could conflict with data protection law.
