New COVID 19 LAW drafted

The Ministry of Health presented a new draft law on Sunday, which among other things also regulates possible curfews, the planning of which recently provoked sharp criticism from the opposition. The new package of measures provides five reasons why people are allowed to leave their private homes despite the restrictions in force.

Unlike last time, five exceptions are now explicitly mentioned:

  • To “avert immediate danger to life, limb and property.
  • On “care and assistance for persons in need of support”.
  • To cover the necessary basic needs of daily life (food shopping etc.)
  • For “professional and work purposes, if necessary”.
  • For “physical and mental recovery”.
    Of course, these measures should only be taken if the pandemic were to get out of control.

The new Covid measure law allows extensive interventions in our everyday life. By the end of 2021, it should be possible in Austria – after approval by the main committee of the Austrian Parliament – to introduce entry bans and curfews.

Bans on entering and controls in offices
The new draft law also provides for bans on entering business premises, means of transport, workplaces and public places.

If the regulations are disregarded, magistrates and district governors can impose up to 1,450 euros for private persons and up to 30,000 euros for companies.

In addition, the district administrative authority can “control compliance with conditions and requirements – also by on-site inspections”. On the one hand, this is apparently intended to protect employees and on the other hand to curb further infections in companies.
