City of Vienna tightens Corona penalties significantly once again. Mask violators face a fine of up to 500 euros.

New penalties for Corona offenders have been set with the recent COVID-19 protective measures ordinance that governs the current soft lockdown. Police are now empowered under the Epidemic Act 1950 and the COVID-19 Measures Act to impose fines with organ penalty orders of up to 90 euros.

This concerns both the violation of the prescribed minimum distance of two meters and the mask requirement. Whereas the previous ordinance previously provided for 25 euros (MNS violation) and 50 euros (no spacing) as penalty amounts for organ mandates, the amount of 90 euros now applies in each case. At least, that is how the federal government sees it.

However, the City of Vienna is now going even further. The administrative penal authority has now adapted the penalty rates and they are even higher.

With the disregard of the minimum distance in the future 120 euro and for the injury of the mask obligation a punishment of 120 euro with penalty order can be raised. However, there is still more air upwards, as the City of Vienna informs:

“The legal maximum penalty for the offenses – not keeping a distance and not wearing MNS – is 500 euros in administrative criminal proceedings (according to § 8 para. 2 COVID-19-MG and according to § 40 para. 2 EpiG).”

Violation of the curfew also continues to be punishable by a fine of at least 150 euros – there is no organ penalty order on this. The nighttime curfew applies from 8 p.m. to 6 a.m.

There are special regulations for young people between the ages of 14 and 18:

With a penalty of 120 euros for adults, juveniles can thus expect a penalty of 60 euros after being reported.

In the case of a curfew violation, the previous penalty rate of 75 euros remains in effect for juveniles.

Even though the penalties have now been increased, the Viennese authorities warn that this is not the end of the story: “Based on the experience of the last few months, changes to the respective applicable ordinance provisions must be expected. The penalties could therefore also be subject to a corresponding adaptation.
